This is nonsense!
You are not required to take evasive action. There is no action on your part that relieves this kid of the consequences of his breaking the law. Since he caused the accident by breaking the law, you were not legally obligated to take evasive action.
Furthermore, the insurance company would need to specify the nature and kind of evasive action the they say could have prevented the accident, and then prove that, had you taken it, such action would have, in fact, prevented the accident. Have them put this in writing.
Don’t let these a**holes run your over with their nonsensical rhetoric. Call a lawyer and have him write a letter. If that doesn’t do the trick, file a lawsuit and have them served with a subpoena.
