You may register your copyrighted work with any year you wish, up to and including 2009.
Publishing professionals know that all work is covered by copyright law. What you sell to them is the right to publish (copy) your work in a specified manner (first, reprint, electronic, all, etc.) The publisher does not usually copyright your story.
