PEN name vs REAL name

Postby HawkEliz489 » Fri May 13, 2016 8:29 am

Hi guys.
This might sound silly, but I'm wondering how 'protected' your work can be under the Pen name?
What I mean is, you practically give yourself a new name and publish your book under that name, right? But what if somehow there show up some kind of issue, like for example you'll have to prove that your book is indeed written by you. Then how do you prove that the person under the pen name is actually you? Do you register your pen name somewhere and get all the claims for it? Do you get any official permission to have 'another' name? Or do you just simply 'put' your made up name on the book cover and that's it? No problems in the future?

Your agent will take care of all the legal details. Self-published? Your site (Amazon, Smashwords) has all the details that you've provided them.

If you get to publish with an editor, you'll have to sign the contract with your real name (legally, its the only one that matters), and in the contract itself you can registre what name are you goint to use in the cover.

Do you register your pen name somewhere and get all the claims for it?
No, but you DO registre your book (which is the most important thing to do, but usually the editor will do that for you. You can do it alone, anyway, if you are selfpublishing). With your real name, too. Book titles and pen names are not registrable.

Do you get any official permission to have 'another' name? Or do you just simply 'put' your made up name on the book cover and that's it? No problems in the future?
Simply put the name! Its not illegal!

I've heard it said to save your older manuscripts, even if incomplete, as your book evolves as evidence of your work. You should date your archived material, as well, to show a (lengthy) timeline of effort developing your story. Anyone else claiming to own your work would be hard pressed to present all the work (and copious notes) behind the scenes.

If you commercially publish, the publisher will, and must, register the book with the Library of Congress. If you self-publish, you need to do the same thing for yourself.

Now, worrying about someone stealing you book is completely unjustified. It's so rare than I can't even remember a case where it happened. There are millions of books out there, and the only ones worth stealing are the ones that have made a lot of money. By that time, it's too late for anyone to steal it. They can pirate it, but not steal it.

This said, if you self-publish you are required to register your nook. No one will come after you if you don't register it, and but if there's a plagiarism or copyright infringement case, the first question you'll be asked is why you didn't register your book. Registering is the only real proof there is that you wrote the book when you say you wrote it. It's there for your protection, so courts take a dim view of those who do not use this protection.
