brand names

Postby mikesimages@yahoo.com » Wed Feb 08, 2012 7:45 pm

I have a question about brand names. I have a story in which I use a popular product, am I allowed to use it without any legal issues, or is it content specific?
For example, am I allowed to say, "Bob drank a Pepsi." without having to worry about being sued by Pepsi corp?
Content specific- If I say "Bob drank a Pepsi and then croaked because of the poisons in it." would that now be not allowed because of the description being less than complimentary?
Or do I need permission from the company?

Please help.

it's done all the time and there are no legal restrictions on doing so... unless, of course, you use it in a derogatory way, such as claiming it was the company's fault someone got poisoned by a bottle of pepsi, for which you could and most likely would be sued till the cows come home...

you need to study up on the legal end of being a writer if you intend to make that your career... can do so here:
