Unusual problem?

Maybe this has happened to other writers? I had already started work on my novel, plot and characters including names. Then I start watching a tv series, and discover some of my characters' names on this show (weird part is, some of them are rather uncommon names). I thought it was quite a coincidence and thought about changing my characters names. I stubbornly didn't want to do that. I ended up changing some names anyway, to names that better suited characters' ethnicity. I thought that fixed it, but it just happened again, with a different series, so now I guess i should change another characters name now too. to clarify something, i don't watch TV, like almost never, so i don't even see commercials, i would never have heard those names in any way. the only tv i watch is on netflix, anyway, thought it was weird coincidence and wondered if something similar happened to anybody else.

Since it's not one of the very primary characters (on the show and in my novel), more of a secondary character, maybe the name doesn't matter and I don't have to change it?

Names aren't able to be protected by copyright. They COULD be trademarked, though. Other than name and maybe ethnicity (since you mention it), are there any more similarities between the characters?

Stephen King named one of his characters John Smith (The Dead Zone). Does that mean that no one else can ever use John Smith? I don't think so. On the other hand, if you use Luke Skywalker, you could be in trouble.

Get the difference?

Names go in cycles of popularity, also. Another thing to consider is the combination of given name plus surname, which is where you could run into problems. As rob noted, "John Smith" is not a problem. Luke is not a problem; McCain is not a problem. But (showing my age here), "Lucas McCain" could be a problem.

Thank you for your feedback. I apologize for waiting so long to thank you. I know that names of characters aren't copyrighted. I just don't want there to be so many similarities to other works. It's hard enough trying to be original. Everything has been done before lol. I guess, all you can do is find an unusual twist and present it well. One can hope lol. I'm currently having a motivational problem. I got discouraged for a while and having trouble getting my focus back into the project. Kind of forcing myself to work on it a little bit every day now. What would you all suggest to combat this? A little break from it? or is that bad?

I would say yes, work on it every day, however little, however terrible. If you're stuck on a particular scene, just play with it. Be as ridiculous as you want with it - working out of the box can lead to tremendous solutions.

The problem with just taking a break from a story you're having trouble with is that it's very easy never to get back to it. You want to build good writing habits. Finishing what you start is, IMHO, the most important habit to develop. A very, very close second is writing every day. Once you've developed those habits into second-nature, you can relax a little, because it's harder to break a habit than it is to form one. That's why "veterans" can take 'vacations' from writing, or move more easily between one book and another. They know what their limits are for breaking (or bending) those habits. It allows them to stop and catch their breath, as it were. But until you get to that point - keep slogging on. It's hard and it's frustrating, but developing the discipline is what divides the successful writers from the wannabes.

thank you, yes, that's what I figured. working everyday, no matter what. I posted a new topic just now. Im kind of stuck on my plans from here on out. i just dont like what i have planned. or I am worrying too much, about everything, as usual haha

People can sue but that doesn't mean it will get to trial. For one thing, attorneys want to get paid. They either demand the money up-front or work on a contingency - either way, the person bringing the lawsuit is going to have to pay at some point. If they have a contingency agreement, their attorney is betting they will win. If the attorney doesn't think they will, they aren't going to take the case.

Then there's a summary judgement - where the defense argues there's no case and the judge agrees. The case is tossed out, and the defendant can ask for repayment of any legal costs. Again, money out of the plaintiff's pocket.



So yes, it can be a pain to deal with, but if one hasn't infringed on a trademark or copyright, it shouldn't be something to worry about.
